Das Oberlandesgericht München legte die sogenannte Mindestverbüßungsdauer auf insgesamt 24 Jahre fest und lehnte es zudem ab, die weitere Vollstreckung der Strafe zur Bewährung auszusetzen.

Zschäpes Verhalten in der Haft bot demnach „keine Anhaltspunkte für ein Fortbestehen der rechtsextremistischen Einstellung“.
Deshalb blieb das OLG ein Jahr unter den von der Bundesanwaltschaft geforderten 25 Jahren.
